Blood alcohol testing is required after a driver has been arrested for Bucks County DUI-driving under the influence. PA DUI law requires full compliance with request by a Bucks County or State Police officer to take either a blood alcohol content (B.A.C.) test. Under current PA drunk driving law, your blood must be tested within two hours of your operation of the vehicle.

Most lower Bucks County police officers will immediately take you to the closest hospital to have a nurse withdraw a sample of blood. This blood sample is then taken to a local laboratory for testing.  At the local Bucks County hospital, you will be required to sign a consent form for the blood testing.

You will receive the results of your Bucks County DUI blood alcohol content (B.A.C) test from the Bucks County District Attorney as part of the Discovery in the Bucks County DUI case.   Sometimes your Bucks County DUI attorney can obtain the results of your B.A.C. test at your Preliminary Hearing.

A few Bucks County police departments use the breath test machine at the local police station to test your blood alcohol level. There are many laws and regulations governing the maintenance and operation of these breath test machines.

It is important to retain an experienced Bucks County DUI lawyer such as Michael L. Saile, Jr., Esq. to determine whether the breath test machine was working properly and whether the breath test was performed as required by PA DUI law.

If you refuse to take either the blood or breath B.A.C. test, you will be charged with a Refusal and be subject to the highest DUI penalties and also an independent one-year or more license suspension administered by the Pennsylvania Department of Transportation (PennDot).
